I-589 Asylum — The One-Year Filing Deadline

Most asylum claims die on the one-year deadline, not the merits. Knowing the exceptions can save the case.

INA §208(a)(2)(B) requires asylum applications within one year of last US arrival. Two exceptions exist: changed circumstances materially affecting eligibility, and extraordinary circumstances explaining the delay.
